Having Your Say on Planning Applications

Man anxious to make commentAll planning applications we receive will be the subject of publicity.

We aim to ensure that all potentially interested individuals and bodies are consulted on a planning application.

Our normal form of publicity is to send individual letters to residents allowing 21 days in which to pass comment. Alternatively, or in addition, we will advertise the details of the planning application by placing a "Site Notice" on or adjacent to the land in question and/or inserting an advertisement in the Public Notices column of the relevant local newspaper. For Sutton and Kirkby we use 'The Chad'; for Hucknall 'The Dispatch'; and for Selston, Underwood and Jacksdale we use 'The Eastwood and Kimberley Advertiser'.

We will normally deposit a copy of the Plans, Application Forms and any supporting documents on the website or at the local area office in Nottingham Road, Selston. In addition we consult the Selston and Annesley/Felley Parish Councils on applications submitted in their respective areas.

Our policy with regard to consulting on planning applications can be found in the Council's Code of Conduct and Procedures (2004) which is available from the main Council Offices or by searching Committee Reports & Minutes.

Comments must be submitted to the Council in writing either using the postal system or by e-mail. Each application has a dedicated Planning Officer (Case Officer), and their e-mail address is indicated in all of our documentation. Contact details for Development Advice and Control.

You can also comment online by searching Planning Services for the planning application you are interested in (e.g. here are the planning applications we received last week) and selecting the link to add your comment.

We will acknowledge receipt of all comments and once a decision is made we will send you a copy of the decision notice. For applications that are decided by Planning Committee there will be a further opportunity to speak by addressing the Committee itself. Details will be sent to you together with a copy of the Report to committee.

Please note that certain matters can be considered by the Council in deciding a planning application whilst others cannot.

Planning issues include the development's impact on visual and residential amenities.

Non-planning issues include loss of property value, commercial competition, loss of view, land ownership disputes. If you are concerned about any of these then you may wish to contact a Solicitor. You can receive free advice from the East Midlands Planning Aid Service (EMPAS).
